Affiliate Programme Terms and Conditions

Please read the following Terms and Conditions carefully before using our Affiliate Programme. If you have any questions, please do not hesitate to contact us.

Changes

We may change any terms and conditions in this agreement at any time and at our sole discretion. These changes may include, but are not limited to, changes to the scope of available referral fees, fee schedules, payment procedures and rules of the Affiliate Programme.

Registration

To register for the Affiliate Programme, you must accept the Terms and Conditions.

TERMS AND CONDITIONS OF THE MKC MOTO AFFILIATE PROGRAMME

Article 1 - Definitions

1.1. MKC Moto: Motorkledingcenter BV, located at Rijndijk 2b, 2394 AH Hazerswoude-Rijndijk, the Netherlands, registered with the Chamber of Commerce under number 28108227.

1.2. Affiliate: any natural person aged 18 or older or legal entity that registers and is accepted for participation in the MKC Moto affiliate programme, has accepted these General Terms and Conditions and undertakes to comply with them.

1.3. Affiliate programme: the programme through which Affiliates promote MKC Moto and receive a commission for successful transactions.

1.4. Commission: the remuneration that an Affiliate receives based on purchases made via unique affiliate links.

1.5. Unique affiliate link: a link provided by MKC Moto that assigns generated sales to a specific Affiliate.

Article 2 - Participation

2.1. Participation in the affiliate programme is only possible after approval by MKC Moto.

2.2. MKC Moto reserves the right to refuse an application without giving reasons.

2.3. The Affiliate is obliged to provide accurate and complete information when registering.

Article 3 - Obligations of the Affiliate

3.1. General obligations: The Affiliate must at all times conduct marketing and promotional activities in accordance with applicable laws and regulations, including privacy legislation. The use of misleading or unfair practices, such as false advertising or unsolicited email marketing (spam), is strictly prohibited.

3.2. Restrictions on promotion: The Affiliate may not:

  • Send unsolicited emails (spam) or post unsolicited messages in (closed) groups, newsgroups, social media pages, forums or as comments on blogs or (news) websites;
  • Infringe on the intellectual property rights of MKC Moto or third parties, including copyrights, trademarks and other protected works;
  • Spread misleading information or deceive third parties, for example by promoting false claims or expired promotions;
  • Use the brand name “MKC Moto” or variants thereof in paid advertisements or search engine campaigns without express written permission;
  • Masking or hiding unique affiliate links for the purpose of deception or unwanted cookie placement;
  • Generating traffic through methods that are not transparent or that do not meet MKC Moto's standards.

3.3. Content guidelines for promotional channels: The content of the Affiliate's channels may not:

  • Contain pornographic, offensive or violent material;
  • Actively promote political beliefs or impose social/political views on third parties;
  • Discriminate on the basis of race, gender, sexual identity or orientation, religion or belief;
  • Engage in, promote or endorse illegal activities;
  • Damages the good name and reputation of MKC Moto;
  • Infringes on copyrights, trademark rights or other rights of MKC Moto or third parties.

3.4. Specific approval for certain forms of promotion: The Affiliate may only carry out promotion via the following channels with the explicit written consent of MKC Moto:

  • Email marketing
  • Advertising networks
  • Search engines
  • Other forms of traffic acquisition

A separate approval procedure is required for email marketing. The Affiliate must complete a questionnaire for each type of medium and obtain explicit prior consent from MKC Moto for each individual mailing. MKC Moto may also require additional questionnaires for other media channels.

The Affiliate is not permitted to modify the HTML link codes provided by MKC Moto. Artificially stimulating clicks or rewarding visitors for clicking on affiliate links is also prohibited, at the discretion of MKC Moto.

Article 4 - Compensation and Payment

4.1. The Affiliate will receive a commission on approved purchases generated through his/her affiliate links.

4.2. Commissions are paid monthly, provided that the minimum amount of EUR 50 has been reached and only after the expiry of the return periods currently applicable in the MKC Moto webshop.

4.3. Returns or cancelled orders will result in the correction or recovery of commissions paid.

4.4. MKC Moto reserves the right to adjust commission percentages and structures. Changes will be communicated in a timely manner.

4.5. The Commission for “business” Affiliates referred to in Article 4 is exclusive of VAT. If applicable and under Dutch law, VAT will be calculated and paid on the Commission, provided that the Affiliate has a VAT number.

Article 5 - Duration and Termination

5.1. This agreement is entered into for an indefinite period and may be terminated by either party in writing with 7 days' notice.

5.2. MKC Moto reserves the right to terminate the cooperation immediately if the Affiliate acts in violation of these terms and conditions.

5.3. Upon termination, the right to future commission payments shall lapse, unless otherwise agreed.

Article 6 - Liability and Indemnification

6.1. MKC Moto shall not be liable for any damage or loss arising from participation in the affiliate programme.

6.2. The Affiliate indemnifies MKC Moto against claims from third parties resulting from unlawful or misleading use of promotional materials.

Article 7 - Confidentiality

7.1. The Affiliate undertakes not to disclose any confidential information about MKC Moto, its methods, techniques or data provided to third parties during and after the term of this agreement. This also includes all information arising from the affiliate agreement(s).

Article 8 - Other provisions

8.1. MKC Moto reserves the right to amend these terms and conditions. Affiliates will be notified of any such amendments in a timely manner.

8.2. This agreement is governed by Dutch law. Disputes will be submitted to the competent court in [place].
